ASSAULT – NOT GUILTY

The Defendant was charged with Assault in violation of 720 ILCS 5/12-2. In Illinois this is a class C Misdemeanor that is punishable by up to 30 days in jail. In this case, the Defendant, a nursing student, allegedly got into an altercation with a fellow classmate and grabbed a knife in the school cafeteria an allegedly lunged at the alleged victim and threatened to kill her.

While this may not seem like the biggest or most serious crime in the world, it was to the Defendant. The Defendant was in nursing school and was in the United States on a Student Visa and risked losing that visa if convicted of this crime that she claimed she did not commit.

The Defendant retained Chicago Criminal Defense Attorney Michael P. Schmiege to represent her. Mr. Schmiege reviewed the file and interviewed the witnesses that were present during the altercation. During this trial preparation it came to light the Defendant and victim had previously had bad blood between them. Mr. Schmiege took the case to trial and extensively cross-examined the complaining witness regarding her feelings toward the Defendant and cast doubt upon her story. During closing arguments Mr. Schmiege argued to the judge that the complaining witness was not credible and simply could not be believed and the Judge agreed and the Defendant was found NOT GUILTY.

In this case, the charge may as well have been murder because if the Defendant would have been found guilty she would have been kicked out of school and had her visa terminated.
